TOUR CONTRACT AND TERMS & CONDITIONS
1. Booking Your Holiday
Your contract in respect of your holiday is made with Antique Safari Adventures Limited, registered in Uganda. All bookings are subject to these terms and conditions.

- All communication regarding your booking will be sent to the address or contact provided in your booking form.
- All bookings must be made through an authorised representative of the Company. A completed booking form and a deposit of 50% of the total cost must be submitted, unless otherwise stated.
- Receipt of deposit and booking form does not confirm the booking. A booking is only confirmed when the Company issues a written confirmation notice. The Company reserves the right to decline a booking without explanation; in such a case, any deposit received will be refunded.
- Bookings made within 15 days of departure require full payment at the time of booking.
- Any special requests (e.g., dietary needs) must be indicated at the time of booking.
- The Company will provide services as outlined and confirmed in writing.
2. Price Policy

- The Company is not obliged to provide a breakdown of costs for any tour.
- Prices are fixed once confirmed. No reductions are made in response to currency appreciation.
3. Cancellation and Changes by the Company

- This trip will proceed according to the planned itinerary.As detailed. If major changes occur, the Company reserves the right to make changes to any tour at any time as follows:

4. Cancellation and Changes by You

- You may cancel your holiday at any time provided you notify the Company in writing.
- Pre-paid permits such as Gorilla , Chimpanzee and Golden monkeys permits are non refundable regardless of when you have cancelled.
- The following cancellation fees will apply on other services:
- Cancellation less than 7 days before the tour: No refund
- Cancellation less than 14 days before the tour: 50% refund
- Cancellation more than 14 days before the tour: 75% refund
5. Our Responsibilities

- The Company does not own or manage the accommodations or facilities used during the tour. It cannot guarantee or inspect all services but selects providers with care.
- Lodges in the itinerary need Your approval.
- With alternatives matching the budget and location,The tour company may switch lodges if the listed ones are unavailable when booking.
- And we recommend checking lodges online beforehand.
- The Company is not liable for death, illness, or injury resulting from:
- your actions or omissions,
- those of a third party,
- unforeseeable or unavoidable events.
- The Company accepts no liability for incidents arising from activities not part of your confirmed itinerary. Assistance will be provided where appropriate.
- No refund will be issued for unused tickets unless a refund is available from the provider.
- The Company is not liable for delays, loss, or damage to luggage or effects unless caused directly by a Company representative’s negligence.

6. Your Responsibilities

- You must obtain comprehensive travel insurance. Details of each traveler’s policy must be submitted with the booking form.
- You are responsible for securing valid passports, visas, and health documentation.
- You must check in for flights and attend all scheduled activities on time. The Company is not responsible for missed flights or unused services.
- Disruptive or inappropriate conduct may result in termination of your tour without refund. Compensation for damages may be pursued.
- Disclose any pre-existing medical conditions during booking.
- Personal equipment and belongings remain your responsibility.
- You must behave responsibly and follow the instructions of guides to ensure safety.
7. Children and Minors

- Travelers under 18 must be accompanied by an adult. Age restrictions may apply to certain activities.
8. Smoking Policy

- Smoking is prohibited in Company vehicles. Regular stops for smokers can be arranged.
9. Health & Fitness Requirements

- Certain activities may be physically demanding. It is your responsibility to ensure you are fit for participation. The Company reserves the right to exclude unfit clients.
10. Force Majeure

- The Company is not liable for failure to perform its obligations due to events beyond its control, including natural disasters, political unrest, border closures, pandemics, strikes, or supplier failure.
11. Tour Handover Policy

- Due to local regulations, guides may not cross certain national borders. In such cases, the Company will coordinate a seamless handover between professional guides in each country.
12. Payment Terms and Currency

- All payments are to be made in United States Dollars or Ugandan Shillings. Accepted methods include bank transfer, credit card, and cash. Clients are responsible for any transaction fees.
- Bank Transfers: Please note a $40 transfer fee per transaction ($20 your bank and $20 my bank).
- Payments made via Visa card are subject to a 4% processing fee.
- All payments are to be made in United States Dollars or Ugandan Shillings. Accepted methods include bank transfer, credit card, and cash. Clients are responsible for any transaction fees.
13. Emergency Contact

- An emergency contact number will be provided. Clients should use it for urgent matters during the tour.
14. Waiver of Responsibility

- Clients may be asked to sign a Waiver of Responsibility before the tour begins, acknowledging that participation carries inherent risks.
15. Limitation of Liability

- The Company’s liability is limited to the price paid for the tour. The Company is not responsible for any indirect or consequential losses.
16. Disclaimer

- The Company strives to ensure accuracy of its promotional materials but is not liable for errors or omissions.
17. Complaints and Dispute Resolution

- All disputes are governed by Ugandan law and subject to the jurisdiction of Ugandan courts.
- Information provided by the Company is accurate to the best of its knowledge.These Terms & Conditions override any other representations.
18. Data Protection

- Personal information may be collected for operational needs. This information is kept confidential and only shared with third parties as required to deliver the contracted services.
19. Confirmation and Booking Procedure

- After the deposit is paid, it will take 4-5 working business days to be reflected into our bank account.
- After the payment is reflected in our bank account, the Company Reservations Desk will within 7 days confirm hotel availability and pay the hotel fees to secure the reservations.
- Once confirmed, all hotel proof of reservations will be sent to the client.
- In the event that the client is unable to check in due to a booking issue caused by the agency, the agency will provide a replacement of the same or higher level in the same location. Otherwise, compensation will be required.

22. Payment of Balance and Vehicle Breakdown

- The remaining balance will be paid before the start of the tour. by either cash or online card system.
- In case of vehicle breakdown, the company will immediately arrange an alternative car in good condition.
23. Travel Support

- Once the contract takes effect, the travel agency is obligated to provide guidance and communication support regarding the travel arrangements. Any issues that arise should be promptly and proactively addressed until the trip is completed.
24. Personnel Clause
-
- The designated guide and driver must be experienced professionals who have a long-standing working relationship with Antique Safari Adventures Limited..
- If the guide causes loss of trust (e.g. lack of knowledge, repeated wrong routes), a replacement may be requested.
- If the guide’s unprofessional conduct disrupts the trip, the tour company will immediately replace him with another guide upon request.
